The Federal Constitutional Court rejected a request for an enforcement order under § 35 BVerfGG. The Court held that it was not apparent that such an order was necessary to implement the requirements contained in the judgment of 12 September 2012 in the related constitutional proceedings.
§ 35 Halbs. 2 BVerfGG; enforcement order under the Federal Constitutional Court Act may be issued only where this is necessary to secure implementation of the Court’s operative directions. Absent indications that the judgment cannot otherwise be carried out, the request is to be rejected. The mere existence of a prior constitutional judgment does not, by itself, justify extraordinary enforcement assistance (cf. consid. 1 ff.).
