Resumo Omnilex

The Federal Constitutional Court rejected an application for an interim order concerning the use of a town hall for a state party congress. It held that the alleged interference with rights under Article 21(1) GG concerned the merits and that the applicant had not shown that it would be unreasonable to first seek relief in the main proceedings. The applicant also failed to explain why the congress had to be held inevitably at the planned place and time. The rejection was made irrespective of any lack of procedural authority.

Sumário Omnilex

Art. 21 Abs. 1 GG; § 32 Abs. 1 BVerfGG: Interim relief is refused where the asserted impairment pertains to the main proceedings and the applicant does not make plausible that pursuing the ordinary merits route would be unreasonable. The party seeking urgent constitutional protection must show a need for immediate intervention; it is insufficient to invoke abstract urgency or to allege a rights violation without substantiating why the planned event must necessarily occur at the specified place and time (cf. consid. 1 ff.). The Court may deny the request without addressing procedural authority if the substantive prerequisites for interim relief are not met.

Ablehnung des Erlasses einer einstweiligen Anordnung: Überlassung einer Stadthalle für Landesparteitag - Zumutbarkeit der Beschreitung des Hauptsacherechtswegs

Tenor
