The Federal Constitutional Court refused to issue an interim injunction sought against provisions of the Hessian Gaming Hall Act. It held that the application was inadmissible because the complainant failed to substantiate, as required by §§ 23(1) sentence 2 and 92 BVerfGG, that the challenged rules would cause it a serious and irreparable disadvantage of its own. The asserted compliance costs and expected loss of visitors were considered insufficiently concrete. Because no adequately substantiated personal disadvantage had been shown, the Court did not need to decide whether alleged harm to players could independently support interim relief.

Der Antrag auf Erlass einer einstweiligen Anordnung wird zurückgewiesen.

Gründe

1 Der Antrag, die Geltung der § 5 Abs. 1 Nr. 5, § 5 Abs. 2 in Verbindung mit Abs. 1 Nr. 5, §§ 6, 7, 11 und 12 Abs. 1 Nr. 8, 9 und 12 bis 16 HessSpielhG bis zur Entscheidung über die Verfassungsbeschwerde einstweilen auszusetzen, ist unzulässig.

2 Der Antrag auf Erlass einer einstweiligen Anordnung genügt jedenfalls nicht den gesetzlichen Anforderungen an die Begründung gemäß § 23 Abs. 1 Satz 2, § 92 BVerfGG. Die Beschwerdeführerin hat nicht in nachvollziehbarer und hinreichend substantiierter Weise dargelegt, dass ihr durch die Vorschriften der angegriffenen Gesetze ein endgültiger und nicht zu kompensierender Schaden entsteht (vgl. BVerfGE 106, 351 <357>). Die Behauptungen der Beschwerdeführerin, dass die Einführung des Sperrsystems Spielhallenbetreiber zu erheblichen finanziellen Investitionen zwinge, deren Amortisation ungewiss sei, und dass die Installierung entsprechender Zugangskontrollen in den Spielhallen einen Besucherrückgang um 30 % zur Folge haben werde, sind nicht ausreichend substantiiert.

3 Somit bedarf es keiner Entscheidung, ob die Ausführungen der Beschwerdeführerin zu der von ihr behaupteten Verletzung von Grundrechten der betroffenen Spieler genügen, um einen schweren Nachteil gemäß § 23 Abs. 1 Satz 2, § 92 BVerfGG zu begründen. Ein Antrag gemäß § 32 Abs. 1 BVerfGG ist nur dann zulässig, wenn ein Beschwerdeführer zumindest auch einen eigenen schweren Nachteil hinreichend substantiiert vorträgt. Nur in diesem Fall können im Rahmen der Folgenabwägung auch die Nachteile für Dritte berücksichtigt werden (vgl. BVerfGE 112, 284 <292>; 121, 1 <17 f.>). Ansonsten könnte sich die Beschwerdeführerin im Verfahren über die einstweilige Anordnung zum Sachwalter fremder Rechte und Interessen machen.
