The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant had not properly exhausted the legal remedies required by § 90(2) sentence 1 BVerfGG, particularly with respect to the part of the complaint relying on an alleged violation of the ECHR. The order is final and not appealable.

§ 90 Abs. 2 S. 1 BVerfGG; constitutional complaint and exhaustion of remedies when an alleged fundamental-rights violation is based on the ECHR. A constitutional complaint is inadmissible unless the complainant has fully exhausted the available legal remedies. This exhaustion requirement applies equally where the asserted constitutional breach is supported by a claim of violation of the European Convention on Human Rights; the complainant must raise the ECHR-based argument in the prior instances in a procedurally proper manner (cf. BVerfGE 112, 50; 129, 78).

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen; insbesondere hat die Beschwerdeführerin, soweit sie sich zur Begründung einer behaupteten Grundrechtsverletzung auf einen Verstoß gegen die Europäische Menschenrechtskonvention beruft, den Rechtsweg nicht ordnungsgemäß erschöpft (vgl. BVerfGE 112, 50<62>; 129, 78 <93>).

Diese Entscheidung ist unanfechtbar.
