The Federal Constitutional Court rejected an application for an interim order aimed at preventing the entry into force of §§ 113b and 113c TKG, introduced by the 10 December 2015 data retention act. Gründe

1 Der Antrag auf Erlass der begehrten einstweiligen Anordnung gemäß § 32 Abs. 1 BVerfGG hat keinen Erfolg. Das Vorbringen des Antragstellers lässt nicht erkennen, dass Nachteile, die mit dem Inkrafttreten des Gesetzes nach späterer Feststellung seiner Verfassungswidrigkeit verbunden wären, die Nachteile, die im Falle der vorläufigen Verhinderung eines sich als verfassungsgemäß erweisenden Gesetzes einträten, in Ausmaß und Schwere deutlich überwiegen (vgl. BVerfGE 104, 23 <27>; 117, 126 <135>; 121, 1 <17>; stRspr).

2 Diese Entscheidung ist unanfechtbar.
