Resumo Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant, who alleged a violation of the right to be heard, had failed to exhaust legal remedies because no hearing complaint had been filed against the Higher Regional Court's decision. The complaint was therefore inadmissible in full on subsidiarity grounds. In addition, the filing did not satisfy the statutory substantiation requirements because the constitutional violation was not made comprehensible and essential documents were missing. The pending request for interim relief became moot.

Sumário Omnilex

Art. 103 Abs. 1 GG; § 90 Abs. 2 S. 1 BVerfGG; admissibility of a constitutional complaint alleging denial of the right to be heard; a hearing complaint must be exhausted before the Federal Constitutional Court may be seized. Where the complainant directly invokes a hearing violation but omits the available hearing complaint, the constitutional complaint is inadmissible as a whole on grounds of subsidiarity if the remaining complaints concern the same subject matter (consid. 1). In addition, the complaint must satisfy the substantiation requirements of §§ 23(1) sentence 2, 92 BVerfGG by making the alleged rights violation comprehensible and submitting the necessary documents; otherwise non-admission also follows on that ground (consid. 2).

Titelzeile

Whether the constitutional complaint was admissible despite no prior hearing complaint against the appellate court decision

Decisão extraída

No. A complaint alleging a violation of the right to be heard is inadmissible if the available hearing complaint was not used to exhaust legal remedies.

Fundamentação extraída

Because the complainant expressly relied on Article 103(1) GG, exhaustion of remedies under Section 90(2) sentence 1 BVerfGG required a prior hearing complaint. The other asserted fundamental-right violations concerned the same subject matter and did not cure the missing subsidiary step.

Questão jurídica principal

Whether the complaint satisfied the substantiation requirements

Decisão extraída

No. The pleading did not make a rights violation comprehensible and key documents were missing.

Fundamentação extraída

Under Sections 23(1) sentence 2 and 92 BVerfGG, the complaint must set out the constitutional violation in a comprehensible manner. The filing failed to do so and omitted essential materials needed to assess the facts.

Questão jurídica principal

Whether the request for interim relief remained pending after non-acceptance

Decisão extraída

It became moot because the constitutional complaint was not admitted.

Fundamentação extraída

Once the main constitutional complaint was not accepted for decision, the interim relief request lost its independent subject matter.
