The Second Senate of the Federal Constitutional Court dismissed an election complaint. It held that the complaint had no prospect of success for the reasons set out in the rapporteur’s letter of 5 April 2016 and, pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, gave no further reasons.
§ 26 Abs. 3 S. 3 EuWG i.V.m. § 24 S. 2 BVerfGG; election complaint dismissed without further reasons where the complaint has no prospect of success. If the Court relies on the reasons communicated by the rapporteur and sees no need for additional explanation, it may forgo a full statement of reasons and summarily reject the complaint (cf. consid. 1).
