The First Chamber of the Second Senate of the Federal Constitutional Court did not admit the constitutional complaint against a removal order under Section 58a Residence Act. It also rejected the applicant’s request for legal aid and appointment of attorney Rechtsanwältin I. because the intended complaint had no sufficient prospect of success. As a consequence, the request for interim relief was moot.
§ 93d Abs. 1 S. 3 BVerfGG; constitutional complaint against a removal order under § 58a AufenthG: where the intended constitutional challenge offers no sufficient prospect of success, the complaint need not be admitted. In such a case, legal aid and appointment of counsel are to be refused for want of prospective success. An application for interim relief dependent on the main proceedings becomes moot once the complaint is not admitted.

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.
Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung.
Diese Entscheidung ist unanfechtbar.
