The Second Senate of the Federal Constitutional Court dismissed a recusal motion against Judge Müller as inadmissible and also rejected a Wahlprüfungsbeschwerde. The complaint was found unsuccessful for the reasons already set out in the rapporteur’s letter of 4 April 2017; pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, the court declined to provide any further reasoning.
§ 19 BVerfGG; § 24 S. 2 BVerfGG; § 26 Abs. 3 S. 3 EuWG; summary dismissal of recusal motion and election complaint: a recusal motion may be rejected as inadmissible without substantive examination where the requirements are not met. An election complaint may likewise be dismissed without further reasons if, according to the statutory reference mechanism, the court relies on the grounds already communicated by the rapporteur and abstains from a detailed statement of reasons under § 24 S. 2 BVerfGG in conjunction with § 26 Abs. 3 S. 3 EuWG.
