The Federal Constitutional Court declined to accept the constitutional complaint. It held the complaint inadmissible because the complainant had not satisfied the stricter requirements of material subsidiarity. As a consequence, the pending request for an interim order became moot. The Court gave no further reasons pursuant to § 93d Abs. 1 sentence 3 BVerfGG.

§ 90 Abs. 2 S. 1 BVerfGG; material subsidiarity of the constitutional complaint: Beyond formal exhaustion of legal remedies, the complainant must also invoke available and suitable remedies at the lower court level in a timely and substantively sufficient manner. A constitutional complaint is inadmissible if the alleged constitutional violation could have been remedied in the ordinary proceedings and the complainant failed to do so. If the main complaint is not accepted, an ancillary request for interim relief becomes moot (consid. 1).

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Mit der Nichtannahme der Verfassungsbeschwerde wird der Antrag auf Erlass einer einstweiligen Anordnung gegenstandslos (§ 40 Abs. 3 GOBVerfG).

Gründe

1 Die Verfassungsbeschwerde ist unzulässig, weil sie den Anforderungen der - über das Gebot der Rechtswegerschöpfung im engeren Sinne hinausgehende - materiellen Subsidiarität nicht genügt (vgl. BVerfGE 107, 395 <414>; 134, 106 <115 Rn. 27> stRspr).

2 Von einer weiteren Begründung im Übrigen wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

3 Diese Entscheidung ist unanfechtbar.
