Resumo Omnilex

The Federal Administrative Court noted that the appellant withdrew its revision against the Baden-Württemberg Higher Administrative Court judgment with the respondent's consent. The revision proceedings were therefore terminated. The intervener's objection did not matter: under § 66 VwGO, an intervener may only submit substantive requests and cannot prevent termination of the dispute by withdrawal, because the intervener remains in a dependent procedural position.

Sumário Omnilex

§ 66 VwGO; effect of an intervener's objection to withdrawal of a revision: An intervener may make motions in the proceedings, but due to its dependent procedural status it cannot prevent termination of the case by withdrawal of the revision with the respondent's consent. This applies even where the intervener was joined as a necessary intervener; the intervener's lack of power to block termination follows from the ancillary nature of its participation (consid. 2).

November 1991 - BVerwG 4 C 27.90 - NVwZ-RR 1992, 276; Beschluss vom 7. Juni 1968 - BVerwG 4 B 165.67 - NJW 1968, 2395).

Questão jurídica principal

Whether the revision proceedings must be terminated after withdrawal of the revision with the respondent's consent.

Decisão extraída

Yes. The revision was withdrawn with consent, so the proceedings had to be terminated under the VwGO provisions cited by the court.

Fundamentação extraída

Withdrawal of the revision by the appellant, combined with the respondent's consent, ends the appellate proceedings; the court therefore orders termination.

Questão jurídica principal

Whether an intervener can prevent termination of the proceedings by objecting to the revision withdrawal.

Decisão extraída

No. An intervener may make substantive motions under § 66 VwGO, but cannot block a settlement-ending withdrawal of the case; the intervener's dependent procedural status remains decisive.

Fundamentação extraída

The court held that even in mandatory joinder, the intervener's dependent position does not disappear, so the intervener's objection is procedurally irrelevant to the withdrawal.
