Resumo Omnilex

The Federal Administrative Court granted the defendant's complaint and admitted the revision. It held that the case raised a question of fundamental importance concerning whether, when fixing the ban period under § 11(1) AufenthG, the requirement of prior departure may be waived for persons entitled to asylum. Because revision was allowed on that ground, the other asserted grounds no longer needed to be addressed.

Sumário Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of revision for fundamental importance; the revision is to be admitted where the case presents a legally unresolved question of general significance and offers an occasion to clarify the conditions under which, in determining the duration of the ban effect under § 11(1) AufenthG, the requirement of prior departure may be dispensed with for asylum beneficiaries. Once this ground is established, further grounds for leave need not be examined.
