The Federal Administrative Court granted the defendant leave to appeal against a Saxon Higher Administrative Court judgment. The lower court had held that house plots which do not themselves satisfy Section 64 LAnpG generally cannot be included in a land reorganization procedure because they lack a reorganization interest under Section 53(1) LAnpG. Gründe

1 Die Beschwerde der Beklagten ist begründet. Die Revision ist nach § 132 Abs. 2 Nr. 2 VwGO zuzulassen. Das angefochtene Urteil stellt den Rechtssatz auf, dass Hausgrundstücke, die für sich nicht die Voraussetzungen des § 64 LwAnpG erfüllen, wegen fehlenden Interesses an einer Neuordnung i.S.d. § 53 Abs. 1 LwAnpG grundsätzlich nicht in ein Bodenordnungsverfahren einbezogen werden können. Damit weicht das angefochtene Urteil von dem entscheidungstragenden Rechtssatz im Urteil des erkennenden Senats vom 29. Juli 2002 - BVerwG 9 C 1.02 - Buchholz 424.02 § 64 LwAnpG Nr. 9 S. 8) ab, wonach in das Verfahrensgebiet für ein Bodenordnungsverfahren auch solche Grundstücke einbezogen werden können, die zwar für sich die Voraussetzungen des § 64 LwAnpG nicht erfüllen, ohne die aber - etwa unter dem Gesichtspunkt der Erschließung - eine sinnvolle Lösung des zugrunde liegenden sachenrechtlichen Konflikts nicht zu erreichen wäre.
