STATE OF CALIFORNIA DECISION OF THE PUBLIC EMPLOYMENT RELATIONS BOARD SANTA CLARITA COMMUNITY COLLEGE DISTRICT, Employer, and PART-TIME FACULTY UNITED, AFT, Petitioner. Case No. LA-RR-1081-E Administrative Appeal PERB Order No. Ad-332 February 26, 2004 Appearances: Liebert, Cassidy, & Whitmore by Kevin Dale, attorney, for Santa Clarita Community College District; Law Offices of Robert J. Bezemek by Martin Fassler, Attorney, for Part-Time Faculty United, AFT. Before Baker, Whitehead and Neima, Members. DECISION NEIMA, Member: This case is before the Public Employment Relations Board (PERB or Board) on an administrative appeal by Part-Time Faculty United, AFT (PFU) to lift a stay imposed by the Board agent in this representation case. The stay was imposed pending resolution of an appeal by the Santa Clarita Community College District (District) of the Board’s decision in a separate but factually related unfair practice case Santa Clarita Community College District (College of the Canyons) (2003) PERB Decision No. 1506. Since the filing of this mater, the Court of Appeal has issued a decision rejecting the District’s appeal. The Board agent then lifted the stay in this matter, allowing PFU’s representational proceedings to move forward. By letter dated December 3, 2003, PFU informed the Board that the stay had in fact been lifted and elections held. Accordingly, PFU
requested to withdraw its administrative appeal. Based on these facts, the Board finds that a withdrawal is in the best interests of the parties and is consistent with the purposes of the HEERA. ORDER The request of the Part-time Faculty United, AFT to withdraw the administrative appeal in Case No. LA-RR-1081-E is hereby GRANTED. Accordingly, the appeal is WITHDRAWN. Members Baker and Whitehead joined in this Decision. 2
