Barnes’ petition for panel rehearing is granted in light of the Supreme
Court’s March 20, 2019 decision in 17-1307, Obduskey v. McCarthy & Holthus
LLP, 586 U.S. __ (2019). Barnes’ petition for rehearing en banc is denied as moot.
The memorandum disposition filed on April 17, 2018 is withdrawn. A schedule
for replacement briefing will be established by separate order. This case shall be
placed on an oral argument calendar once briefing is complete.
