______________________________________________________________________________
In August 2023, Sanita Kopstale, appellant, entered in the Circuit Court for
Worcester County a plea of guilty to second degree assault and false imprisonment. The
court subsequently convicted Ms. Kopstale of the offenses. At sentencing, the court
imposed a total term of imprisonment of three years, all but sixty days suspended, and a
subsequent term of probation of five years. In November 2025, Ms. Kopstale filed a
“Motion for Judicial Review of Newly Discovered Material Evidence,” in which she
contended, in pertinent part: “Subsequent review of agency records and case materials has
produced new evidence directly relevant to the nature of the conduct and the absence of
any physical or mental injury to the child.” The court denied the motion.
Ms. Kopstale now appeals from the denial of the motion. But, Ms. Kopstale does
not cite any authority that classifies the denial as a final judgment from which she may
appeal. See Md. Code (1974, 2020 Repl. Vol., 2025 Supp.), § 12-301 of the Courts &
Judicial Proceedings Article (generally, “a party may appeal from [only] a final judgment
entered in a civil or criminal case by a circuit court”). Accordingly, we dismiss the appeal.
APPEAL DISMISSED. COSTS TO BE PAID
BY APPELLANT.
