320 Alabama Emergency Management Agency

Ala. Admin. Code r. 320-4-1-.01 General

The Alabama Emergency Management Agency has implemented "The Alabama Emergency Management Agency Plan" which consists of five separate plans, each addressing a specific operational area. These plans are consistent with current federal laws, regulations and guidance. The officials authorized to submit plan materials to the Federal Emergency Management Agency are the Governor and the AEMA Director.

Ala. Admin. Code r. 320-4-1-.02 Operational Plans For The State

These plans contain a broad concept of operations, assignment of responsibilities to state agencies, designation of direction and control facilities, and details the communications systems and usages. The plans contained in Volumes II through V are considered, for the purpose of 44 CFR 302, as integral parts of the Administrative Plan, Volume 1, hereafter referred to as the Alabama Emergency Management Agency Administrative Manual.

(a) Volume I - ADMINISTRATIVE MANUAL (PLAN). This volume contains the administrative policies and procedures which govern the emergency management program in Alabama; a compendium of legislation which affects the program; references; and agreements with other states, state agencies, volunteer agencies and the private sector. Forms and related guide documentation are also included.

(b) Volume II - RESOURCES MANAGEMENT PLAN. This plan concerns the management of surviving resources in a post nuclear attack environment; the management of resources and major economic shifts required to support the in-place and evacuation option and the provision of resource support in the event of a widespread natural disaster. This plan was developed in 1968 and requires revision when federal funding is provided to AEMA.

(c) Volume III - ALABAMA NATURAL DISASTER PLAN. The Natural Disaster Plan sets forth the state and federal response procedures for natural disasters and selected man-made disasters; i.e., hazardous materials, search and rescue, and others.

(d) Volume IV - NUCLEAR CIVIL PROTECTION PLAN. The Nuclear Civil Protection Plan is primarily concerned with the effects of nuclear attack and includes the protection of population under the two existing options for nuclear attack: protection in-place in the event of an attack without warning, or protection by evacuation (formerly called crisis relocation) in the event of a serious international crisis.

(e) RADIOLOGICAL EMERGENCY PLAN. This Plan outlines the state response to incidents at nuclear power plants.

1. State Agency Plans and Procedures. AEMA will prepare implementing procedures to support the various state level plans. The procedures will be based on the functions and responsibilities set forth in the plans, executive orders and agreements.

Ala. Admin. Code r. 320-4-1-.03 Operational Plans For The Locals

Local Plans must be consistent with federal and state plans; be based on an analysis of the existing or potential hazards facing the jurisdiction; assign peacetime/attack emergency functions to government departments and nongovernment agencies; specify who is in charge of emergency operations; establish intergovernment relationships; establish procedures for requesting state or federal assistance; be approved by the local chief executive; be reviewed annually and updated as required; include programs for testing and exercising, training, informing the public about things that require public action and be formally accepted by the AEMA Director.

(a) As a minimum, the County Emergency Operations Plan (EOP) must follow the format and philosophy of the AEMA All-Hazards Emergency Operations Plan (Prototype). The Basic Plan and supporting annexes must be integrated to address all hazards identified in the current county hazards analysis. Additionally, the plan must comply with applicable Federal Planning Guidance.

(b) A local emergency operations plan is considered current if it has been published, revised or reviewed and changed on an annual basis; it was prepared and approved using the criteria in CPG l-8A, as modified by the state; and it has been accepted by the AEMA director.

(c) RADIOLOGICAL EMERGENCY PLAN. This plan outlines the local response to incidents at nuclear power plants.

1. County Plans and Procedures: Each county affected by a fixed nuclear facility will include supplemental guidance in the County Emergency Operations Plan and establish implementing procedures that will assure the protection of the health and safety of residents within the Emergency Planning Zones (EPZ). These plans will be compatible with the basic plan for emergency response for incidents at fixed nuclear facilities. Local plans will be based on local and state plans, executive orders and agreements.

Ala. Admin. Code r. 320-4-1-.04 Adoption By Reference

Any federal or state law or regulation hereafter cited within any rule of any division of this agency as a referral basis for that rule shall be considered to be an adoption of that law or regulation by this agency. Copies of each such law or regulation thus cited as a referral basis for a rule shall be properly filed with the Legislative Reference Service and with the Secretary of the Agency in accordance with the Alabama Administrative Procedure Act.
