SECOND CLASS CITIES ALLOWED TO LEASE LAND
Act of Jul. 20, 1917, P.L. 1137, No. 392 Cl. 11
AN ACT
Empowering cities of the second class, under certain conditions,
to lease streets or highways along navigable streams, or
streets or highways created by act of Assembly, to private
persons, for a limited time, and to receive a rental
therefor.
Section 1. Be it enacted, &c., That cities of the second
class shall have power to lease to any person or persons any
street or highway, or part thereof, laid out or opened along a
navigable stream, or streets or highways, or parts thereof,
created by act of Assembly, within the limits of said city,
wherever, in the judgment of the corporate authorities of said
city, the said streets, highways, or parts thereof, are not
necessary for immediate public use. Said lease or leases may be
made for a period of not exceeding ten years; subject, however,
to the condition that said lease or leases may be terminated by
said city whenever, in the judgment of the corporate
authorities, the same may be necessary or required for the use
of the general public.
Section 2. The terms of said lease or leases shall be made
by ordinance of said city, fixing the compensation or terms
thereof, and prescribing the terms and conditions under which
said lease may be terminated as provided by section one hereof.
Section 3. The said leases or leasing under the authority of
this act, or renewal or extensions thereof, shall not be taken
or construed as a vacation or abandonment of said streets or
highways, or parts thereof; and the said streets or highways, or
parts thereof, which may be leased, shall always continue and
remain as public streets and highways, subject only to the
temporary use thereof under the terms and conditions of said
leases or leasing.
