LOCAL PROJECT 70 LAND - TRANSFER IN SCHUYLKILL COUNTY

                                  AN ACT

     Authorizing the Board of Schuylkill County Municipal Authority
        to transfer certain Project 70 lands in New Castle, Ryan and
        Blythe Townships in Schuylkill County to Crown American
        Corporation in exchange for a certain parcel of land
        containing the Mud Run Dam.

        The General Assembly of the Commonwealth of Pennsylvania
     hereby enacts as follows:

        Section 1.  Authorization of Transfer; Conditions.--Pursuant
     to the requirements of section 20(b), act of June 22, 1964 (Sp.
     Sess., P.L.131, No.8), known as the "Project 70 Land Acquisition
     and Borrowing Act," the General Assembly authorizes the Board of
     the Schuylkill County Municipal Authority to transfer the
     hereinafter described land in New Castle, Ryan and Blythe
     Townships, Schuylkill County, to Crown American Corporation in
     exchange for a certain parcel of land containing the Mud Run
     Dam.
        Such land shall be free of the restrictions on use and
     alienation prescribed by section 20, act of June 22, 1964 (Sp.
     Sess., P.L.131, No.8), known as the "Project 70 Land Acquisition
     and Borrowing Act," upon:
        (1)  completion of the exchange transfer to the authority of
     a certain parcel of land containing the Mud Run Dam; and
        (2)  execution and filing of a document of exchange and
     release, citing such exchange and release of the said land from
     the restrictions on use and alienation prescribed by section
     20(b) of said act.
        Section 2.  Description of Project 70 Land to be
     Transferred.--The land to be transferred by the Board of the
     Schuylkill County Municipal Authority to Crown American
     Corporation in exchange for the transfer of a certain parcel or
     property containing the Mud Run Dam is more particularly
     described as follows:
        All that certain piece, parcel or tract of land situate in
     New Castle, Ryan and Blythe Townships, Schuylkill County,
     Pennsylvania, bounded and described as follows, to wit:
        Beginning at an iron pin in the common line of lands now or
     late of Mt. Laurel Enterprises and Schuylkill County Municipal
     Authority; thence along said Mt. Laurel lands north 88 degrees
     29 minutes 00 seconds east, 3,034.56 feet to an iron pin located
     in the western right-of-way of Legislative Route No. 161 south
     bound; thence along said right-of-way for the following 12
     courses and distances (1) south 29 degrees 35 minutes 30 seconds
     east, 178.71 feet to an iron pin (2) north 60 degrees 24 minutes
     30 seconds east, 113.00 feet to an iron pin (3) south 33 degrees
     24 minutes 30 seconds east, 82.50 feet to an iron pin (4) south
     53 degrees 27 minutes 00 seconds west, 15.00 feet to an iron pin
     (5) south 39 degrees 46 minutes 30 seconds east, 61.02 feet to
     an iron pin (6) south 29 degrees 37 minutes 30 seconds east,
     149.42 feet to an iron pin (7) by a curve to the right with a
     radius of 788.12 feet having a chord of south 26 degrees 50
     minutes 00 seconds east, 76.77 feet to an iron pin (8) by a
     curve to the right with a radius of 606.66 feet having a chord
     of south 13 degrees 53 minutes 00 seconds east, 46.40 feet to an
     iron pin (9) south 11 degrees 41 minutes 30 seconds east, 171.74
     feet to an iron pin (10) by a curve to the right with a radius
     of 382.45 feet having a chord of south 5 degrees 28 minutes 30
     seconds east, 82.83 feet to an iron pin (11) south 00 degrees 44
     minutes 30 seconds west, 85.62 feet to an iron pin (12) north 89
     degrees 15 minutes 30 seconds west, 10.00 feet to an iron pin
     and other lands of the aforementioned Municipal Authority;
     thence along said Municipal Authority lands for the following
     four courses and distances (1) south 60 degrees 00 minutes 00
     seconds west, 570.00 feet to an iron pin (2) south 82 degrees 00
     minutes 00 seconds west, 1,200.00 feet to an iron pin (3) north
     76 degrees 40 minutes 00 seconds west, 1,183.00 feet to an iron
     pin (4) north 34 degrees 05 minutes 00 seconds west, 1,089.69
     feet to the point of beginning.
        Containing 74.946 acres as bounded and described according to
     a survey by James J. Sterner, Jr., Professional Engineer No.
     21084-E.
        Section 3.  Description of Lands to be Acquired by
     Authority.--The land to be conveyed by the Crown American
     Corporation to the Schuylkill County Municipal Authority in
     exchange for the transfer of the Project 70 Land described in
     section 2 is more particularly described as follows:
        All that certain piece, parcel or tract of land situate in
     New Castle Township, Schuylkill County, Pennsylvania, bounded
     and described as follows:
        Beginning at a point on the north line of lands of the
     Schuylkill County Municipal Authority being the southeast corner
     of tract herein described and the southwest corner of Parcel No.
     1; thence south 83 degrees 44 minutes west, a distance of 110
     feet, more or less, to a point; thence south 72 degrees 55
     minutes west, a distance of 6,390 feet, more or less, to a
     point; thence north 30 degrees 30 minutes west, a distance of
     3,050 feet, more or less, to a point; thence north 89 degrees 12
     minutes east, a distance of 460 feet, more or less, to a point;
     thence north 75 degrees 52 minutes east a distance of 3,031.64
     feet, more or less, to a point; thence north 12 degrees 37
     minutes west, a distance of 215 feet, more or less, to the
     southern right-of-way line of Interstate Route No. 81; thence
     along said right-of-way south 88 degrees 37 minutes east, a
     distance of 3,895 feet, more or less, to a point; thence south
     17 degrees 05 minutes east, a distance of 1,750 feet, more or
     less, to the point of beginning.
        Containing 400 acres more or less as bounded and described
     according to a survey by James J. Sterner, Jr., Professional
     Engineer No. 21084-E.
        Section 4.  Right-of-way.--Crown American Corporation shall
     also convey to the Schuylkill County Municipal Authority an
     easement or right-of-way to enable the authority to gain access
     to Mud Run Dam. Said easement or right-of-way is described as
     follows:
        All that certain piece, parcel, or tract of land situate in
     New Castle Township, Schuylkill County, Pennsylvania, bounded
     and described as follows to wit:
        Beginning at a point located in the center line of Service
     Road "B" at Station 16 + 98.00, and in an eastern property line
     of lands now or late of Mt. Laurel Enterprises, thence through
     said Mt. Laurel Enterprises lands for the following ten courses
     and distances (1) north 84 degrees 58 minutes west 99.96 feet to
     a point (2) by a curve to the right with a radius of 573.69 feet
     having a chord of north 60 degrees 57 minutes 30 seconds west
     467.12 feet to a point (3) north 36 degrees 56 minutes 30
     seconds west 191.37 feet to a point (4) by a curve to the left
     with a radius of 403.34 feet having a chord of north 59 degrees
     12 minutes west 305.71 feet to a point (5) north 81 degrees 39
     minutes west 51.06 feet to a point (6) by a curve to the left
     with a radius of 359.27 feet having a chord of south 87 degrees
     44 minutes 30 seconds west 132.28 feet to a point (7) south 77
     degrees 8 minutes west 30.25 feet to a point (8) south 80
     degrees 31 minutes west 271.12 feet to a point (9) south 83
     degrees 36 minutes 30 seconds west 75.21 feet to a point (10)
     south 84 degrees 05 minutes 30 seconds west 47.57 to a point on
     the eastern property line of lands intended to be conveyed to
     Schuylkill County Municipal Authority.
        The above described line being the center line of a permanent
     right-of-way of a uniform width of 20 feet as bounded and
     described according to a survey by James J. Sterner, Jr.,
     Professional Engineer No. 21084-E.
        Section 5.  Project 70 Conditions.--The deed from Crown
     American Corporation to the Schuylkill County Municipal
     Authority shall contain the following clause:
        This indenture is given to provide land for recreation,
     conservation and historical purposes, as said purposes are
     defined in the act of June 22, 1964 (Sp. Sess., P.L.131, No.8),
     known as the "Project 70 Land Acquisition and Borrowing Act."
        Section 6.  Effective Date.--This act shall take effect
     immediately.
