Any person who wilfully or negligently:

  1. fails to fulfil his or her duties of care as a person authorised to deal with narcotics;
  2. breaches the provisions on narcotics advertising and information;
  3. breaches storage and retention obligations;
  4. breaches an implementation regulation issued by the Federal Council or the relevant department, the contravention of which is declared a criminal offence, or an order issued to him containing a reference to the penalty under this article;

shall be liable to a fine.
