Commentaries: Art. 8e

Extra-parliamentary commissions shall be established by order of the Federal Council.
The establishment order shall have the following in particular as content:
1. It justifies the need for the commission and describes its tasks in detail.
2. ¹ .
3. ² It states the number of members and, if applicable, the reasons for exceeding the legal maximum number of members.
4. ³ .
5. It regulates how the commission is organised.
6. It regulates reporting procedures and the provision of information to the public.
7. It regulates the duty of confidentiality.
8. ⁴ It specifies the remuneration category to which the commission belongs in accordance with Articles8n and8p and Annex 2.
9. It determines the rights to use any copyright-protected works and processes that may be produced.
10. If necessary, it regulates the relations of the commission with cantons, parties and other organisations.
11. ⁵ It assigns the commission to the competent authority (a department or the Federal Chancellery) and designates the administrative office that provides the secretariat for the commission.
12. ⁶ It names the body responsible for financing the extra-parliamentary commission.
13. ⁷ It regulates the Commission’s right to information in dealings with the Administration.
m.⁸For extra-parliamentary commissions entrusted with supervisory or regulatory tasks, it contains the profile of requirements for their members.
