The FOCBS shall prosecute and adjudicate contraventions that it detects within its area of jurisdiction (Art. 11 para. 1 let. a).1Violations of Article 245 of the Criminal Code2shall be prosecuted and adjudicated by the cantons.
FOCBS proceedings are governed by the Fixed Penalties Act of 18 March 20163.
If the offender rejects the fixed penalties procedure or if the fine is not paid within 30 days, the FOCBS shall prosecute and adjudicate the contravention in accordance with the Federal Act of 22 March 19744on Administrative Criminal Law.
