1. The question of what constitutes a public offer is determined on the basis of Article 3 letters g and h of the Financial Services Act of 15 June 2018¹(FinSA).
2. Offers to schemes and persons in accordance with Article 65 paragraphs 2 and 3 are not deemed public.
