Commentaries: Art. 27d

An administrative investigation shall be entrusted to persons who:
1. meet the necessary personal, professional and technical requirements for such a task;
2. are not active in the area of responsibility to be investigated; and
3. are not simultaneously and in the same matter entrusted with disciplinary proceedings or other personnel law proceedings.
The investigation may be delegated to persons outside the Federal Administration. Such persons shall act as agents of the ordering body.
The investigative bodies may issue directives within the scope of their mandate, but may not issue rulings.
The provisions on recusal in Article 10 of the Federal Act of 20 December 1968¹on Administrative Procedure (APA) applymutatis mutandis .
