This Act applies to:
1. the Railways Act of 20 December 19571,
2.2 .
3.3 the Passenger Transport Act of 20 March 20094,
4.5 the Trolleybus Act of 29 March 19506,
5.7 the Federal Act of 3 October 19758on Inland Navigation,
6. the Civil Aviation Act of 21 December 19489, or
7.10 the Cableways Act of 23 June 200611, with the exception of ski lifts and aerial cableways with fewer than nine places in each transport unit;
c. residential buildings with more than eight residential units where authorisation for their construction or renovation is granted following the commencement of this Act;
d. buildings with more than 50 workplaces where authorisation for their construction or renovation is granted following the commencement of this Act;
e.12 services that are in principle made available to any person by undertakings that require an infrastructure licence under Article 5 of the Railways Act of 20 December 1957 or a passenger transport licence under Article 6 of the Passenger Transport Act of 20 March 2009, other licensed undertakings or state authorities;
f. basic and advanced education and training;
g. employment contracts under the Federal Personnel Act of 24 March 200013.

Art. 3 BehiG erstreckt sich unter anderem auf grundsätzlich von jedermann beanspruchbare Dienstleistungen des Gemeinwesens. Eine Benachteiligung bei der Inanspruchnahme einer solchen Dienstleistung liegt nach Art. 2 Abs. 4 BehiG vor, wenn sie für Menschen mit Behinderungen nicht oder nur unter erschwerenden Bedingungen möglich ist.
“Das BehiG hat zum Zweck, Benachteiligungen zu verhindern, zu verringern oder zu beseitigen, denen Menschen mit Behinderungen ausgesetzt sind (Art. 1 Abs. 1 BehiG). Gemäss Art. 3 BehiG gilt das Gesetz unter anderem für grundsätzlich von jedermann beanspruchbare Dienstleistungen des Gemeinwesens (lit. e). Eine Benachteiligung bei der Inanspruchnahme einer Dienstleistung liegt gemäss Art. 2 Abs. 4 BehiG vor, wenn diese für Behinderte nicht oder nur unter erschwerenden Bedingungen möglich ist.”
