Commentaries: Art. 42

Any person who wilfully:¹
1. clears forest without authorisation;
2. obtains a payment for himself or others, to which he is not entitled by providing untrue or incomplete information;
3. fails to comply with or hinders the prescribed generation of forest

shall be liable to a custodial sentence not exceeding one year or to a monetary penalty. 2. If the offender acts negligently, he or she shall be liable to a monetary penalty not exceeding 40,000 Swiss francs.
