Any person who brings an action under Articles 72, 73, 74 or 81 and subsequently brings a further action against the same party for the same or a similar act on the basis of another patent must bear the court costs and the other party's costs for the new procedure if he does not provideprima facie evidence that in the prior action he was, through no fault on his part, unable to invoke the other patent.
