A fine not exceeding CHF 500,000 shall be imposed on any person who wilfully:
provides false information or withholds material facts in the prospectus or key information document in accordance with Title 3;
fails to publish the prospectus or the key information document under Title 3 by the beginning of the public offer at the latest.
A fine not exceeding CHF 100,000 shall be imposed on any person who wilfully fails to make the key information document available prior to subscription or conclusion of the contract.
