Art. 23

1. Any person who:
   1. violates Article 10 by failing to declare an activity;
   2. carries out, in full or in part, an activity in breach of the requirement to refrain from activities under Article 11 or Article 39 paragraph 2,

is liable to a custodial sentence not exceeding one year, or to a fine. 2. Where the act has been committed through negligence, a monetary penalty is imposed.
