Article 6 of the Federal Act of 22 March 19741on Administrative Criminal Law (ACLA) applies to offences committed within a business undertaking.
Pursuant to Article 7 of ACLA, an investigation to identify the offenders may be dispensed with and the business undertaking may be ordered to pay the fine instead in cases in which:
the identification of the persons criminally liable under Article 6 of ACLA necessitates investigative measures that would be disproportionate to the penalty incurred; and
the penalty for the contraventions governed by this Act does not exceed 20,000 francs.
