The following courts have jurisdiction to hear actions against a person liable under Article 159 or against the foreign company for which such person is acting:

1. the Swiss courts at the domicile or, in the absence of a domicile, at the habitual residence of the defendant; or
2. the Swiss courts at the place where the company is administered in fact.
