Fedpol is the national contact point for the exchange of dactyloscopic data and personal data in accordance with Articles 6, 11, 15 and 16 paragraph 3 of Decision 2008/615/JHA1.
As the contact point, fedpol performs the following tasks in particular:
It carries out comparisons with dactyloscopic data held in the information system of other participating countries.
It checks hits that have been obtained on the basis of a comparison carried out by Switzerland in the fingerprint information system of a participating state.
On request, it transmits to the requesting participating State the personal data and, where provided for under Swiss law, other available information in accordance with Article 10 of Decision 2008/615/JHA.
On request or on its own initiative, it transmits personal and non-personal data in accordance with Articles 13 and 14 (major events) and 16 (prevention of terrorist offences) of Decision 2008/615/JHA.
It defines maximum search capacities for dactyloscopic data.
The following authorities may, within the scope of their statutory duties, request a comparison in accordance with paragraph 2:
fedpol;
the Office of the Attorney General of Switzerland;
the cantonal police and prosecution authorities.
The Federal Roads Office (FEDRO) is the national contact point for the exchange of data on owners or operators of vehicles and vehicle data in accordance with Article 12 paragraph 2 of Decision 2008/615/JHA. As the contact point, FEDRO grants the requesting contracting state access to the vehicle and vehicle operator data in the IVZ vehicles subsystem for the purposes of Article 12 paragraph 1 of Decision 2008/615/JHA. Access to the data is granted in accordance with Article 15 and Chapter 3 of the Annex to the Decision 2008/616/JHA2.
Terrorist offences within the meaning of Article 16 of Decision 2008/615/JHA are the felonies and misdemeanours referred to in Article 111j paragraph 6 letter a of the Foreign Nationals and Integration Act of 16 December 20053.
