The petition for a pardon may be filed by the offender, their legal representative or, with consent of the offender, by their defence agent, spouse or registered partner.1
In the case of political felonies and misdemeanours and in the case of offences connected with political felonies or misdemeanours, the Federal Council or the cantonal government is also entitled to initiate the pardon procedure.
The pardons authority may stipulate that the petition for a pardon that has been refused may not be filed again before the expiry of a certain period.
