The composition court shall make any enquiries that may still be necessary and, if the application does not prove to be obviously unfounded, shall then order a hearing to which all creditors shall be invited by public notice; if necessary, experts must be consulted.
If the list of creditors submitted by the debtor indicates only a relatively small number of creditors and is deemed credible by the composition court, the court may dispense issuing a public notice and summon the creditors, sureties and co-debtors by personal notification.
The creditors may inspect the files prior to the hearing and submit their objections to the request in writing.
The composition court shall make its decision within a short period of time. In the moratorium authorisation, it may order the debtor to make one or more instalment payments.
