Where a debtor is enjoying a stay of enforcement due to military, civil protection or civil defence service, the creditor may during the stay of enforcement demand that the debt enforcement office draw up a inventory with the effects set out in Article 164.1The creditor must however provideprima facie evidence that his claim exists and that it is endangered by acts of the debtor or third parties that aim to favour individual creditors to the detriment of others or to have a detrimental effect on the creditors in general.
The drawing up of an inventory may be obviated by securing the applicant creditor’s claim.
